1. Definitions.

In these terms and conditions the following meanings will apply:

“the Company” or “we” means Howard Guest and Company Limited, whose registered office is St John’s Innovation Centre, Cambridge CB4 0WS

“Howard Guest” means the individual who has licensed photographs to the Company.

“Customer” means the person or company whose details are entered on any order or enquiry form on this website.

“Browser” means any person accessing and using this website by means of software products enabling Internet connection.

“the Website” means the website at howardguest.co.uk.

2. Copyright.

Howard Guest asserts the moral right to all the photographs and images used on this Website. All rights are reserved and no image may be used without written permission.

3. Products and Services.

Products offered by the Company, including for sale through the Website, include, but are not restricted to, books and photographs. Due to its nature, the precise colour of images details may vary from illustrations.

4. Use of this site

UK customer’s statutory rights are not affected by any of these Terms.

We reserve the right to refuse the supply of goods and services at our discretion.

5. Offer and acceptance

A binding contract is formed between you and us when you receive confirmation from us by e-mail, telephone or other agreed means that your order has been accepted.

6. Delivery

Delivery of products ordered from stock will normally be made within 10 working days within the United Kingdom delivery area, and up to 28 days to addresses with the European Union and US/Canada.

Specific arrangements for non-stock or custom manufactured items will be notified at the time of ordering. Carriage costs, where applicable, will be charged at cost as indicated on the order and confirmed to the Customer with the order acknowledgement.

The Company will use its best endeavours to ensure timely delivery of all orders, but time of delivery will not be capable of being made of the essence of the contract as actual delivery to the Customer will be by independent carrier and outside the direct control of the Company.

7. Goods are subject to availability

Apparels are held in stock and are sold from stock Books offered for sale have a limited life span and may either be re-printing or out-of print. Photographs are not normally held in stock but are printed to order.

Whilst we endeavour to provide the best information on product availability and stock availability, occasionally goods become unexpectedly out-of-print or unavailable. In the event that we are unable to supply the goods or services, we will inform you as soon as possible (normally the same working day).

8. Forthcoming titles

Your payment for a forthcoming title will be processed on the same day you place your order. Full details on planned publishing dates can be found on the individual book details page.

9. Price and Payment

Prices shown on the website are stated in Pounds Sterling and are inclusive of VAT, where this is applicable. The Company reserves the right to vary prices to reflect changes in price from its suppliers without notice and the contract price will be the price quoted in the contract confirmation.

The price of the contract will require to be paid in full prior to dispatch of the products or fulfilment of the services unless otherwise agreed. Payment is of the essence of the contract and the Company will be relieved of any obligation under the contract if payment is not made in accordance with the contract terms.

Overseas (to the UK) customers should check with their bank or credit/debit card company for the exact exchange rate and any additional costs that may be incurred following a transaction in Pounds Sterling.

We reserve the right to decline any credit or debit card including major ones.

Payment by card may be made by entering the card details on the secure payment screen. We are unable to despatch goods until payment had been cleared or authorised. Payment will be processed on the day you place your order.

10. Online security

All reasonable precautions will be taken to ensure the details of your order and payment remain secure. However, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.

Alternatively payment may be made in person at the Company premises or by cheque or bank transfer by arrangement at time of contract.

11. Cancellation

Save as required by the UK Consumer Protection (Distance Selling) Regulations 2000, or pursuant to clause 9 above, the contract will be non-cancellable by the Customer, once confirmed by the Company. Ordering mistakes by Customers will not constitute grounds for cancellation. Notwithstanding, acceptance of cancellation by the Company in exceptional circumstances and any refund or part refund will be solely at the discretion of the Company.

In the event of cancellation of the contract, the Customer will be responsible for the safe return, and all costs of return, of the products in an undamaged, unworn state, together with all original packaging.

You lose the right to cancel if:

– you have had the goods personalised (for example an authors dedication).

– you have opened a sealed publication.

– you have damaged the goods once signed and received for.

12. Returns

In the unlikely event of products being faulty or of sub-standard quality, please report such problem immediately to the Company using the contact details on the website. We offer a FREE returns service in the United Kingdom see Returns

Items can be returned to us provided:

– The item is in its original condition and packaging.

– A copy of the invoice note or proof of purchase is included.

Note: When returning goods we recommend that you use a recorded delivery or trackable service, as we are unable to accept responsibility for returns that fail to arrive.

13. Privacy
13.1 We take your privacy very seriously and will treat all of your personal information in accordance with all applicable data protection laws in England and Wales. Please read our Privacy and Security Policy.

14. Complaints Procedure

We endeavour to respond to all complaints within 7 working days. We will acknowledge receipt of any complaint and give an indication of the timescale expected to resolve the complaint. We will keep you informed regarding the progress of the complaint.

15. Trademarks

All trademarks used are the property of their respective owners. All trademarks are recognised.

16. Governing law and jurisdiction

This contract is subject to the law of England and Wales. All disputes arising out of this contract shall be subject to the exclusive jurisdiction of the courts of England and Wales. Those who access the site from other locations are responsible for compliance with their local laws and taxes as applicable.

Any disputes not resolved by normal complaints procedure will be resolved exclusively in the courts of England and Wales under English Law.

If any provision of these terms and conditions shall be unlawful, void or for any reason unenforceable then that provision shall be excluded and shall not affect the validity and enforceability of the remaining terms and conditions.
